Confession of judgment
A contractual clause allowing a creditor to obtain judgment without a hearing.
Once widely used in merchant cash advance agreements. New York substantially curtailed their use against out-of-state debtors after investigative reporting exposed the practice, and other states have followed.
Where still enforceable, it removes essentially all procedural protection from the borrower.
